What is the qualification of EB1-A (Alien of Extraordinary Ability)?
An EB1-A petition must satisfy a three-prong test:
1. The foreign person must have sustained national or international acclaims for his/her achievements.
USCIS requires the petition to present extensive documentation proving the foreign national's extraordinary ability. Evidence of national or international acclaim may be a major international prize or award, or three of the ten types of evidence discussed below.
2. The foreign person is seeking to enter the United States to continue to work in the field of endeavor that is the subject of the acclaim.
Under USCIS regulations, the petition must show the foreign person's intent to keep working in that field. It must include letters from prospective employers, evidence of prearranged commitments such as contracts, or a statement from the foreign national describing his or her plans to continue working in the field in the United States.
3. The presence of the foreign person and his/her activity will benefit the United States.
USCIS regulations do not require separate proof that the foreign person's admission will substantially benefit the United States. Satisfying the other statutory requirements normally meets this requirement.
